Introduction

Thank you for using Good Story Vacations. We are happy to assist you in planning and booking your next vacation. These Terms of Use state the terms and conditions of your use of goodstoryvacations.com and any third-party services used therein (the “Website”).  Please read these terms before using the Website or communicating with us.

PLEASE READ THIS AGREEMENT CAREFULLY AS IT CONTAINS IMPORTANT INFORMATION REGARDING YOUR LEGAL RIGHTS, REMEDIES AND OBLIGATIONS, INCLUDING VARIOUS LIMITATIONS AND EXCLUSIONS, AND A DISPUTE RESOLUTION CLAUSE THAT GOVERNS HOW DISPUTES WILL BE RESOLVED.

About us

We are Good Story Vacations LLC (“Good Story Vacations,” “we,” “us,” or “our”), an Illinois limited liability company. We operate at 2501 Chatham Rd. STE 8093, Springfield, IL 62704.

Good Story Vacations LLC is registered with the State of Florida as a Seller of Travel, Registration No. ST43378 & the State of California as a Seller of Travel, Registration No. 2150980-70.

Acceptance of Terms

By using the Website, you agree to be bound by and to comply with these Terms of Use (this “Agreement”), whether or not you obtain services from us as a client of Good Story Vacations (“Client”). This Agreement is an electronic contract that sets out the legally binding terms of your use of the Website. If you object to anything in this Agreement or the Good Story Vacations Privacy Policy, do not use the Website. This Agreement may be modified by Good Story Vacations from time to time. Such modifications are effective upon posting by Good Story Vacations on the Website. By accessing and/or using the Website or becoming a Client, you accept this Agreement and agree to the terms, conditions and notices contained or referenced herein.

Access and Retention

In order to access and retain this electronic Agreement, you must have access to the World Wide Web, either directly or through devices that access web-based content. In addition, you must use all equipment necessary to make such a connection to the World Wide Web, including a computer and modem or other access device. Please print a copy of this Agreement for your records. To retain an electronic copy of this Agreement, you may save it into any word processing program.

Eligibility

You must be at least 18 years of age to use the Website. Persons under this age must not use the Website, or submit any individually-identifiable information about themselves. By using the Website, you represent and warrant that you have the right, authority and capacity to enter into this Agreement and to abide by all of the terms and conditions of this Agreement.

Use of the Website 

You can use our Website to obtain information about Good Story Vacations, our services, our team and travel destinations. You must use our Website only according to this Agreement.

  1. You must not copy or capture, or attempt to copy or capture, any content from the Website or any part of the Website, unless given express permission by Good Story Vacations.
  2. You must not copy, republish, adapt, make available or otherwise communicate to the public, display, perform, transfer, share, distribute or otherwise use or exploit any content on or from the Website; provided, however, that you may share limited content from the Website for the purpose of informing others that you are using the Website or to inform others of the existence of the Website and the services available. Any such content that you share must fall within the parameters of fair use.
  3. You must not use any content in any way that replicates any part of the Website’s offering.
  4. You must not employ scraping or similar techniques to aggregate, repurpose, republish or otherwise make use of any content.
  5. You must not alter or remove, or attempt to alter or remove, any trademark, copyright or other proprietary or legal notices contained in, or appearing on, the Website or any content appearing on the Website.
  6. You must not, and must not permit any third party to copy or adapt the object code of the Website, or reverse engineer, reverse assemble, decompile, modify or attempt to discover any source or object code of any part of the Website, or circumvent or attempt to circumvent or copy any copy protection mechanism or access any rights management information pertaining to content.
  7. You must not use the Website to upload, post, store, transmit, display, copy, distribute, promote, share, make available or otherwise communicate to the public and/or other users:

    any content that is offensive, abusive, libelous, defamatory, obscene, racist, sexually explicit, ethnically or culturally offensive, indecent, that promotes violence, terrorism, or illegal acts, incites hatred on grounds of race, gender, religion or sexual orientation, or is otherwise objectionable in Good Story Vacations’ sole and reasonable discretion;

    any information, content or other material that violates, plagiarizes, misappropriates or infringes the rights of third parties including, without limitation, copyright, trademark rights, rights of privacy or publicity, confidential information or any other right;

    any content that violates, breaches or is contrary to any law, rule, regulation, court order or is otherwise is illegal or unlawful in Good Story Vacations’ sole and reasonable opinion;

    any material of any kind that contains any virus, Trojan horse, spyware, adware, malware, bot, time bomb, worm, or other harmful or malicious component, which will or might overburden, impair or disrupt the Website or servers or networks forming part of, or connected to, the Website, or which does or might restrict or inhibit any other user’s use and enjoyment of the Website; or

    any unsolicited or unauthorized advertising, promotional messages, spam or any other form of solicitation.
  8. You must not commit or engage in, or encourage, induce, solicit or promote, any conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any law or regulation.
  9. You must not rent, sell or lease access to the Website, or any content on the Website.
  10. You must not deliberately impersonate any person or entity or otherwise misrepresent your affiliation with a person or entity, for example, by sending messages using the name of another person.
  11. You must not stalk, exploit, threaten, abuse or otherwise harass another Client, or any Good Story Vacations employee or owner. If we feel that your behavior towards any of our employees is at any time threatening or offensive, we reserve the right to immediately terminate your client relationship.
  12. You must not collect or attempt to collect personal data, or any other kind of information about other Clients, including without limitation, through spidering or any form of scraping.
  13. You must not violate, circumvent or attempt to violate or circumvent any data security measures employed by Good Story Vacations; access or attempt to access data or materials which are not intended for your use; log into, or attempt to log into, a server or account which you are not authorized to access; attempt to scan or test the vulnerability of Good Story Vacations’ servers, system or network or attempt to breach Good Story Vacations’ data security or authentication procedures; attempt to interfere with the Website by any means including, without limitation, hacking Good Story Vacations’ servers or systems, submitting a virus, overloading, mail-bombing or crashing. Without limitation to any other rights or remedies of Good Story Vacation under this Agreement, Good Story Vacations reserves the right to investigate any situation that appears to involve any of the above, and may report such matters to, and cooperate with, appropriate law enforcement authorities in prosecuting any users who have participated in any such violations.

You agree to comply with the above conditions and acknowledge and agree that Good Story Vacations has the right, in its sole discretion, but not the obligation, to: (1) monitor the Website for violations of these Terms of Use; (2) take appropriate legal action against anyone who, in our sole discretion, violates the law or these Terms of Use, including without limitation, reporting such user to law enforcement authorities; (3) terminate your client relationship; (4) in our sole discretion and without limitation, notice, or liability, to remove from the Website or otherwise disable all files and content that are excessive in size or are in any way burdensome to our systems; and (5) otherwise manage the Website in a manner designed to protect our rights and property and to facilitate the proper functioning of the Website.

Term and Termination

This Agreement will remain in full force and effect while you use the Website. Good Story Vacations may terminate our client relationship for any reason by sending notice to you at the email address and/or phone number you provide via the Website, or such other email address as you may later provide to Good Story Vacations. All decisions regarding the termination of Client relationships shall be made in the sole discretion of Good Story Vacations. Good Story Vacations is not required to provide you notice prior to terminating your client relationship. Good Story Vacations is not required, and may be prohibited, from disclosing a reason for the termination of your Client relationship. Even after your client relationship is terminated, this Agreement will remain in effect. All terms that by their nature may survive termination of this Agreement shall be deemed to survive such termination. 

Content

You acknowledge that the Website contains materials (collectively, “Content”) that are protected by copyrights, patents, trademarks, trade secrets and/or other proprietary rights, and that these rights are valid and protected in all forms, media and technologies existing now or hereafter developed. All Content is copyrighted under United States copyright laws (and, if applicable, similar foreign laws), and Good Story Vacations owns a copyright in the selection, coordination, arrangement and enhancement of such Content. All trademarks appearing on the Website are trademarks of their respective owners. You may not modify, publish, transmit, distribute, perform, participate in the transfer or sale, create derivative works of, or in any way exploit, any of the Content, in whole or in part. When Content is downloaded to your computer, you do not obtain any ownership interest in such Content. Modification of the Content or use of the Content for any other purpose, including, but not limited to, use of any Content in printed form or on any other website or networked computer environment is strictly prohibited unless you receive our prior written consent.

Good Story Vacations retains all proprietary rights in and to the Website. The Website contains the copyrighted material, trademarks, and other proprietary information of Good Story Vacations, and its licensors. Except where we have given you express written permission, you may not copy, modify, publish, transmit, distribute, perform, display, or sell any such proprietary information. Except where otherwise specified in this Agreement, all content is copyrighted material of Good Story Vacations. Distribution of content to others is strictly prohibited. You agree that Good Story Vacations would be irreparably harmed by any violation or threatened violation of this section and that, therefore, Good Story Vacations shall be entitled to an injunction prohibiting you from any violation or threatened violation of this section, without posting bond, in addition to any other right or remedy it may have. We may provide links to third party websites, and some of the content appearing on Good Story Vacations may be supplied by third parties. Good Story Vacations has no responsibility for these third-party websites nor for their content, which is subject to and governed by the terms of use and/or privacy policies, if any, of the applicable third-party content providers.

By uploading, posting or sending any content originated by you (including individually-identifiable information, and Client testimonials or photos) (collectively “content”) to the Website or a Good Story Vacations’ email addresses (i.e., @goodstoryvacations.com), you permit Good Story Vacations to store your content on our servers and grant us a worldwide, non-exclusive, transferable, sub-licensable, royalty-free and fully paid license to use, copy, store, repost, transmit or otherwise distribute, publicly display, adapt, prepare derivative works of, compile, make available and otherwise communicate to the public, your content utilizing the features of the Website, our social media platforms, including but not limited to the social media platforms of our affiliated independent contractors, any email marketing newsletters or campaign(s), and any other method of communication we so choose at any time. We shall be under no obligation to maintain any comments in confidence, pay compensation for any content, or respond to any content. We may, but have no obligation to, monitor, edit or remove content that we determine, in our sole discretion, to be unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any intellectual property rights or these Terms of Use. You agree that your content will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your content will not contain libelous, or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Website or any related website. You shall be solely responsible for any content you provide to us and their accuracy. We do not accept responsibility or assume any liability for any content posted by you or any third-party. Good Story Vacations will gladly remove and delete Your Content upon request to hello@goodstoryvacations.com.

By submitting non-confidential questions, comments, suggestions, ideas, feedback, or other information related to the Website, you agree that we can use and share such information for any purpose without compensation to you or your Travel Party.

The Website may contain (or you may be sent via the Website) links to other websites (“Third-Party Websites”) as well as articles, photographs, text, graphics, pictures, designs, music, sound, video, information, applications, software, and other content or items belonging to or originating from third parties (“Third-Party Content”). Such Third-Party Websites and Third-Party Content are not investigated, monitored, or checked for accuracy, appropriateness, or completeness by us, and we are not responsible for any Third-Party Websites accessed through the Site or any Third-Party Content posted on, available through, or installed from the Site, including the content, accuracy, offensiveness, opinions, reliability, privacy practices, or other policies of or contained in the Third-Party Websites or the Third-Party Content. Inclusion of, linking to, or permitting the use or installation of any Third-Party Websites or any Third-Party Content does not imply approval or endorsement thereof by us. If you decide to leave the Site and access the Third-Party Websites or to use or install any Third-Party Content, you do so at your own risk, and you should be aware these Terms of Use no longer govern. You should review the applicable terms and policies, including privacy and data gathering practices, of any website to which you navigate from the Site or relating to any applications you use or install from the Site. Any purchases you make through Third-Party Websites will be through other websites and from other companies, and we take no responsibility whatsoever in relation to such purchases which are exclusively between you and the applicable third party. You agree and acknowledge that we do not endorse the products or services offered on Third-Party Websites and you shall hold us harmless from any harm caused by your purchase of such products or services. Additionally, you shall hold us harmless from any losses sustained by you or harm caused to you relating to or resulting in any way from any Third-Party Content or any contact with Third-Party Websites.

Information About You and Your Travel Party

You acknowledge that by communicating with Good Story Vacations, and using the Website, we collect, store, use and process information about you and your Travel Party in accordance with our Privacy Policy. You warrant that all information and data you provide about yourself and your Travel Party is true and accurate.

UNDER NO CIRCUMSTANCES SHALL GOOD STORY VACATIONS, ITS OWNERS, OFFICERS, EMPLOYEES OR AGENTS BE LIABLE FOR ANY COSTS, DAMAGES, OR LOSSES THAT DIRECTLY OR INDIRECTLY ARISE FROM, OR IN CONNECTION TO, INACCURATE INFORMATION YOU OR YOUR TRAVEL PARTY HAVE PROVIDED US TO FULFILL OUR SERVICE TO YOU.

Corrections

The information and Content posted on the Website may contain typographical errors, inaccuracies, or omissions, including descriptions, pricing, and other information about Offerings. We reserve the right to correct any errors, inaccuracies, or omissions and to update the information and Content on the Website from time to time, without prior notice.

Limitation of Liability

The content and functionality on the Website provided by employees of Good Story Vacations are offered “as-is” without warranty of any kind, either express or implied, including, without limitation, implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. Good Story Vacations makes no warranties, express or implied, as to the ownership, accuracy, completeness or adequacy of the Website’s content or that the functionality of the Website will be uninterrupted or error-free or free from virus or third-party attack. Good Story Vacations is not responsible for Suppliers’ breach of contract, failure to comply with any laws, including by not limited to the Americans with Disabilities Act (ADA), negligence or omissions for any Offerings they supply. You hereby acknowledge that your use of this Website is at your sole risk.

UNDER NO CIRCUMSTANCES SHALL GOOD STORY VACATIONS, ITS OWNERS, OFFICERS, EMPLOYEES OR AGENTS AND THEIR RESPECTIVE HEIRS, SUCCESSORS AND ASSIGNS BE LIABLE FOR ANY DAMAGES, INCLUDING DIRECT, INCIDENTAL, PUNITIVE, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES THAT DIRECTLY OR INDIRECTLY RESULT FROM USE OF, OR INABILITY TO USE, THE WEBSITE OR THE INFORMATION CONTAINED THEREIN, INCLUDING WITHOUT LIMITATION FOR VIRUSES ALLEGED TO HAVE BEEN OBTAINED FROM THE WEBSITE, EVEN IF GOOD STORY VACATIONS HAS BEEN NOTIFIED OF THE POSSIBILITY OF SUCH DAMAGES OR LOSSES AND REGARDLESS OF THE THEORY OF LIABILITY.

TO THE GREATEST EXTENT PERMITTED BY LAW, YOU AGREE THAT IN NO EVENT WILL GOOD STORY VACATIONS HAVE ANY LIABILITY, CONTINGENT OR OTHERWISE, FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES IN ANY WAY ARISING OUT OF OR RELATING TO THE AGREEMENT, THE WEBSITE, OR OFFERINGS INCLUDING, BUT NOT LIMITED TO PHYSICAL INJURY, DEATH, LOST PROFITS, LOST DATA, LOSS OF GOODWILL, INFRINGEMENT OF COPYRIGHT, TRADEMARK, OR OTHER INTELLECTUAL PROPERTY RIGHT, WORK STOPPAGE, EQUIPMENT FAILURE OR MALFUNCTION, PERSONAL INJURY, PROPERTY DAMAGE OR ANY OTHER DAMAGES OR LOSSES, EVEN IF GOOD STORY VACATIONS HAS BEEN ADVISED OF THE POSSIBILITY THEREOF, AND REGARDLESS OF THE LEGAL OR EQUITABLE THEORY (CONTRACT, TORT, STATUTE, INDEMNITY OR OTHERWISE) UPON WHICH SUCH LIABILITY IS BASED.

In no event shall Good Story Vacations be liable for any damages whatsoever, whether direct, indirect, general, special, compensatory, consequential, and/or incidental, arising out of or relating to the Website or use thereof. Nothing contained in the Website, our materials or third-party materials given by Good Story Vacations shall be construed to make any promise, covenant, warranty, or guaranty, all of which are explicitly disclaimed hereby, contrary to the statements and disclaimers contained in this paragraph.

In the event that any of the foregoing limitations are deemed to be unenforceable, to the greatest extent permitted by law, you agree that the entire aggregate liability of Good Story Vacations and sole remedy available to any Client and Travel Party in any case in any way arising out of or relating to the Agreement or the Website shall be limited to monetary damages that in the aggregate may not exceed the sum equal to commission received by Good Story Vacations or $500, whichever is less.

Indemnity by You

You agree to indemnify and hold Good Story Vacations, its owners, officers, employees or agents, harmless from any loss, liability, claim, or demand, including reasonable attorneys’ fees, arising out of or related to:

  1. your use of the Website in violation of this Agreement and/or arising from a breach of this Agreement including without limitation your representations and warranties set forth above;
  2. any third-party claim of infringement of copyright or other intellectual property rights or invasion of privacy arising from your activity on the Website

Attorneys’ Fees

In the event that Good Story Vacations is successful in whole or in part in any action or proceeding related to or arising from this Agreement, you shall be responsible for Good Story Vacations’ attorneys’ fees and costs.

Privacy

By using the Website, you agree to be bound by our Privacy Policy, which is incorporated into these Terms of Use.

Jurisdiction and Choice of Law; Dispute Resolution

To expedite resolution and control the cost of any dispute, controversy, or claim related to these Terms of Use (each “Dispute” and collectively, the “Disputes”) brought by either you or us (individually, a “Party” and collectively, the “Parties”), the Parties agree to first attempt to negotiate any Dispute (except those Disputes expressly provided below) informally for at least thirty (30) days before initiating arbitration. Such informal negotiations commence upon written notice from one Party to the other Party.

In no event shall any Dispute brought by either Party related in any way to these Terms of Use be commenced more than one (1) year after the cause of action arose.

If there is any dispute arising out of the Website, by using the Website, you expressly agree that any such dispute shall be governed by the laws of the State of Illinois, without regard to its conflict of law provisions, and you expressly agree and consent to the exclusive jurisdiction and venue of the courts of the State of Illinois, having a situs within the County of Cook, for the resolution of any such dispute. Acceptance of the terms and conditions of this Agreement constitutes your consent to be sued in such courts and to accept service of process outside the State of Illinois with the same force and effect as if such service had been made within the State of Illinois. You hereby agree to accept service of process for any action hereunder by certified mail return receipt requested which service shall have the same force and effect as though service had been affected by personal service in the applicable jurisdiction.

No Third-Party Beneficiaries

You agree that, except as otherwise expressly provided in this Agreement, there shall be no third-party beneficiaries to this Agreement.

Availability Outside United States

If you access the Website from outside of the United States, you do so at your own risk and are responsible for compliance with the laws of your jurisdiction. You further acknowledge that any personal information you provide will be processed in the United States and other geographies as selected by us in our sole discretion, and you hereby consent to the collection and processing of your personal information in a manner consistent with this Agreement and the Privacy Policy.

California Users and Residents

If you are unable to receive a satisfactory resolution for any complaint with Good Story Vacations, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, California 95834, or by phone at (800) 952-5210 or (916) 4451254.

Entire Agreement

This Agreement contains the entire agreement between you and Good Story Vacations regarding the use of the Website.

Severability; Waiver

If any provision of this Agreement is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of this Agreement, which shall remain in full force and effect. No waiver of any term of this Agreement shall be deemed a further or continuing waiver of such term or any other term. In addition, Good Story Vacations’ failure to enforce any term of this Agreement shall not be deemed as a waiver of such term or otherwise affect Good Story Vacations’ ability to enforce such term at any point in the future.

Headings

The section headings contained in this Agreement are for reference purposes only and shall not in any way affect the meaning or interpretation of this Agreement.

Contact

Visiting the Website, sending us emails, and completing online forms constitute electronic communications. You consent to receive electronic communications, and you agree that all agreements, notices, disclosures, and other communications we provide to you electronically, via email and on the Website, satisfy any legal requirement that such communication be in writing. YOU HEREBY AGREE TO THE USE OF ELECTRONIC SIGNATURES, CONTRACTS, ORDERS, AND OTHER RECORDS, AND TO ELECTRONIC DELIVERY OF NOTICES, POLICIES, AND RECORDS OF TRANSACTIONS INITIATED OR COMPLETED BY US OR VIA THE WEBSITE. You hereby waive any rights or requirements under any statutes, regulations, rules, ordinances, or other laws in any jurisdiction which require an original signature or delivery or retention of non-electronic records, or to payments or the granting of credits by any means other than electronic means.
