Legendary Program Terms and Conditions

Introduction
The Good Story Vacations Legendary (“Program”) is a loyalty rewards program offered and operated by Good Story Vacations LLC, a limited liability company established and operating in the State of Illinois, and its affiliate advisors (collectively, “Company,” “we,” “us” or “our”). References to “you” “your and Member herein refer to any Company client who is considering or has opted in to participate in the Program.
General Terms
The Program operates under the terms and conditions as set out below (“Program Rules”). The Program Rules as well as the Good Story Vacations Booking Terms and Conditions (“Company Terms”), any applicable third-party supplier (“Supplier”) terms and conditions (“Supplier Terms”), our Privacy Policy (collectively, “Complete Terms”) govern our legal relationship with you, so please read them carefully as the Complete Terms are legally binding. Your participation in the Program is at all times subject to these Complete Terms and constitutes your acceptance and agreement to the Complete Terms.
You are only eligible to enroll in the Program if: (i) you have read, understand, and agree to the Complete Terms; (ii) you consent to our use of personal data in compliance with our Privacy Policy; and (iii) you are at least eighteen (18) years of age and a resident of the United States; (iv) maintain and provide to Company your valid SMS-enabled phone number in the United States; and (v) have a valid email address. You are responsible for ensuring that your participation in the Program complies with all applicable laws and policies related to your participating in the Program. Only eligible individuals (as defined below) shall be able to participate in the Program.
Changes to these Program Rules
We reserve the right to amend, revise, terminate, or suspend the Program or the Program Rules at our sole discretion at any time. If changes have an impact on the value of your Legendary Points, you will receive notice to the email provided for your account and/or booking at least thirty (30) days prior to the effective date of the change. All changes with little to no impact on the value of your Legendary Points, will only receive a change to these rules and will be current as of the “Last Modified” date listed at the top of these rules. and Such changes will be effective immediately upon the display of the revised Program Rules on our Website and will supersede all previous versions. The last revision date will be reflected in the “Last Modified” header above. Your continued participation in the Program constitutes your acceptance to the changes to the Program Rules.
Bonus Points & Additional Promotions
From time to time we may introduce periodic and time-limited promotions which will allow clients to earn bonus points. Any bonus points or promotions will be subject to the terms and conditions of the bonus or promotion and may have different values and/or criteria to qualify for the bonus or promotion.
Definitions
“Account” shall mean the Legendary Program account you create with Company. If you meet the eligibility criteria set forth above and opt in to the Legendary Program, your account will have access to earn Legendary Points.
“Eligible Booking” shall mean (i) a booking by a Member in US Dollars through Company for a Travel Booking that is later completed.
“Eligible Individual(s)” shall mean an individual client, Lead Guest, or Guest of Company. Companies, groups, organizations, or travel agents cannot participate in the Program.
“Eligible Referral” shall mean a booking that is booked with Company and completed by a friend, family member, or third party (collectively, “Referral Client”) of Member due to Member’s referral to Company for travel products and services.
“Eligible Travel Booking” shall mean a vacation booked with Company in US dollars that includes, at minimum, resort or hotel accommodations with certain Supplier(s), cruise booking(s), or an inclusive tour that includes room accommodations, daytime and/or evening tour programming, some or all meals, transfers and transportation booked together through one Supplier that is later completed. Travel bookings may also include dining plans, travel protection insurance, theme park tickets, water park tickets, photo services, rental cars or transfers booked in a package with the Supplier. Items not considered or included in the travel booking include, but are not limited to, vehicle rentals, stand-alone theme park tickets, dining and activity reservations, dining plans (outside of the Supplier package), special event tickets, VIP tours, stroller, scooter or ECV rentals, taxes, resort or any other non-commissionable fees, and any additional services rendered by additional Suppliers.
“Guest” shall mean any individual who is listed on any Eligible Travel Booking through Company.
“Lead Guest” shall mean an individual listed as the primary contact with the Supplier for any travel booking with Company. The name holding the reservation with the Supplier(s) shall be the Lead Guest’s name.
“Legendary Points” are promotional instruments awarded for loyalty to Company and earned by Members who have opted in to the Legendary Program for Eligible Travel Booking (less taxes and fees), booked through Company as the Lead Guest and are only redeemable in Supplier gift cards (of Company’s choosing) are non-transferable, not available for purchase, and have no actual cash value. Legendary Points are based on the total Eligible Travel Booking amount spent, less taxes and fees. Where taxes and fees are not readily available from a supplier, you earn points based on the total Eligible Travel Booking package price less 22% (the average taxes and fees as estimated by Company). In cases where the Supplier does not disclose the taxes and fees in any Eligible Travel Booking package, Company shall have the sole discretion in setting the average tax and fees percentage of 22% regardless of the actual tax and fees percentage for any particular Eligible Travel Booking. Legendary Points shall be awarded to Members within 30 days following the last day of the Eligible Travel Booking reservation.
“Legendary Program” is a loyalty program offered by Good Story Vacations LLC. By participating in this Program, Members who choose to opt in, can earn Legendary Points for booking and completing travel through Company. Members can also earn Legendary Points through referring friends or family to Company who complete an Eligible Travel Booking through Company. Upon request for redemption, Member can then receive Supplier gift card(s) in exchange for Legendary points upon redemption.
“Member” means an Eligible Individual who meets the eligibility requirements set forth above and pursuant to the Program rules and who has opted-in to the Legendary Program.
“Redemption” means a Member’s request to convert Legendary Points into a Supplier gift card for Member’s use in accordance with the Program Terms. To redeem Legendary Points, Member shall submit a request to Company to redeem their points and shall provide the verification code from the portal via SMS-enabled phone number to confirm their account. One (1) Legendary Point shall equal $.005 US Dollars. Upon Redemption, rounding will be at the sole discretion of Company. Any Guest of an active Eligible Travel Booking shall be able to redeem their Legendary Points.
“Supplier(s)” shall mean the third-party company or companies that Company utilizes to book, confirm and service vacation packages or individual components and as defined and set forth more thoroughly in Company’s Terms.
Program Rules
- To be eligible to participate in our Program, you must: (i) read, understand and agree to Complete Rules; (ii) be at least 18 years old and a citizen of the United States, able to create binding legal obligations in connection with your participation in the Program; (iii) consent to our use of your personal data in accordance with our Privacy Policy; (iv) be our client, i.e. have made booking(s) with us; (v) have a valid email address; and (vi) consent to “opt in” to the Legendary Program.
- If Member has been a Guest on another Eligible Travel Booking with Company prior to booking as a Lead Guest, becoming an Eligible Individual, and opting in to the Legendary Program, Member’s earning opportunity, as set forth below, will be based on the number of times Member has been a Guest. (For example, if Member has been listed on two other eligible bookings solely as a guest and not a Lead Guest through Company, and now is booking as the Lead Guest, Member shall have the opportunity to earn (3) Legendary Points for every $1 US Dollar spent on their Eligible Travel Booking with Company).
- When Member completes an Eligible Travel Booking with Company (through our Supplier(s)), Member receives Legendary Points. Legendary Points are non-transferable and may only be redeemed by providing a written request to Company at: legendary@goodstoryvacations.com, (or via the portal) and by providing the verification code received from the Company via SMS-enabled phone number.
- Since Supplier gift cards are sent electronically to the Member’s email address on file with Company, Members shall ensure that all information provided to Company, including but not limited to, name and email address is accurate. Company shall not be liable for any Supplier gift cards that are sent to a different email address than Member requested or expected if different from the email address on file with Company.
- Members of the Legendary Program shall receive one (1) Legendary Point for every $1 US Dollar spent on their Eligible Travel Booking booked with Company, less taxes and fees (see Legendary Points definition), for their first Eligible Travel Booking with Company.
- Members of the Legendary Program shall receive two (2) Legendary Points for every $1 US Dollar spent on their Eligible Travel Booking booked with Company, less taxes and fees (see Legendary Points definition), for their second Eligible Travel Booking with Company.
- Members of the Legendary Program shall receive three (3) Legendary Points for every $1 US Dollar spent on their Eligible Travel Booking booked with Company, less taxes and fees (see Legendary Points definition), for their third Eligible Travel Booking with Company.
- Members of the Legendary Program shall receive four (4) Legendary Points for every $1 US Dollar spent on their Eligible Travel Booking booked with Company, less taxes and fees (see Legendary Points definition), for their fourth and beyond Eligible Travel Booking with Company.
- Members can also earn Legendary Points for referring a friend or family member to Company (“Referrer”). Member shall be awarded 2,000 Legendary Points for each Referral Client that books an Eligible Travel Booking with Company at the time the vacation is completed. The Referral Client shall also receive 2,000 Legendary Points immediately for use on their first trip with Company.
- Once received by the Referral Client, Referral Client must opt-in to the Legendary Program by agreeing to these Program Terms prior to receiving any Legendary Points.
- Legendary Points are: (i) non-transferable and are void if bought, sold, or bartered, advertised for sale, or used for commercial or promotional purposes, (ii) non-refundable and non-returnable, (iii) may not be redeemed for cash, check, credit or for any other value and (iv) have no implied warranties, including warranties of merchantability or fitness.
- Legendary Points can be redeemed by contacting the Company via email, through the portal, or by contacting legendary@goodstoryvacations.com and requesting the redemption of all or some of the Legendary Points and by providing the verification code received by Member in the portal from Company. Upon request for redemption, Company shall email Member the Supplier gift card electronically via the email address on file with Company on the first day of travel booked through Company. Company has sole discretion in which Supplier gift card it provides to Member.
- If Member submits final payment on or within seven (7) days of the first day of travel booked through Company, Company cannot guarantee the timely arrival of the Supplier gift card on the first day of the Member’s travel booked with Company. Company will make reasonable efforts to deliver the Supplier gift card during the Member’s travel, if possible.
- Legendary points can be redeemed for two (2) years from the date of their award. Company is not obligated to extend or reissue this Legendary Points past the expiration date.
- If the Legendary Points are redeemed for less than the total amount of Legendary Points available, the remaining residual Legendary Points may be maintained and added to subsequent Travel Bookings. The resulting expiration date for any residual Legendary Points will match the expiration date for any new Legendary Points awarded for subsequent Travel Bookings with Company.
- Good Story Vacations LLC shall manage the Legendary Points on behalf of all Good Story Vacations Affiliates and Members. Attempts will be made to give access to Members to access their Legendary Points balance online, but this function is not currently available. Members can request a statement of their balance and transactions by emailing Good Story Vacations at: legendary@goodstoryvacations.com. We will do our best to respond to you inquiry with your information within 48 hours. If your statement does not accurately reflect the correct number of Legendary Points that you have earned, we reserve the right to notify you of the inaccuracy, and to adjust your balance accordingly.
- Upon receipt of a Supplier gift card from Company, Member shall have no claim against Company for any of the Supplier gift card terms and conditions, including but without limitation the gift cards terms on the expiration date, locations in which it can be used, etc. Once Company has e-mailed Member their Supplier gift card via the email address provided by Member on file with Company, Company shall have no other obligations or liabilities resulting from its access, loss, use or otherwise.
- Except as prohibited by law, we reserve the right to refuse, void, cancel, reject or hold for review any Legendary Points for any reason, at any time, in our sole discretion (and without notice to you), including, without limitation, if the Legendary Points were issued or obtained, directly or indirectly, in connection with a mistake, fraudulent actions or claims, falsified information, chargeback dispute, compensation abuse or in connection with any violation of Program Rules and Company’s Terms. You further agree that any violation of any of these Program Rules and Company’s Terms may result in (a) the cancellation of your reservation or purchase, (b) your forfeiture of any monies paid for your reservation or purchase, and (c) your being denied access to the applicable travel related product or service.
- Members may not refer themselves or participate in the Program as “Friends.” Members may not use the Program to violate any law, infringe or violate the rights of any third party, or otherwise act in a manner that is deemed harassing, harmful, illegal, hateful, obscene or outside the spirit and intent of the Program. In addition, Referrers may not (i) tamper with the Program, (ii) act in an unfair or disruptive manner or (iii) use any system, bot, or other device to participate or receive any benefit in the Program. ANY ATTEMPT TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROGRAM MAY BE IN VIOLATION OF THE LAWS. IF WE DEEM AN ATTEMPT WAS MADE (IN OUR SOLE DISCRETION), WE RESERVE THE RIGHT TO TERMINATE YOUR PARTICIPATION IN THE PROGRAM, VOID ALL LEGENDARY POINTS ACCUMULATED AND SEEK REMEDIES AND DAMAGES TO THE FULLEST EXTENT OF THE LAW.
Removal from the Program
To opt-out of the Program, you can request to do so by emailing legendary@goodstoryvacations.com. Upon receipt of your request to opt-out, Company will remove you from the Program and provide a statement showing the Legendary Points awarded and Supplier gift cards distributed. If you have any remaining Legendary Points, you will forfeit all points and will not have an option to redeem your points for gift cards.
Becoming a Member of the Program is void where prohibited by law in your state of country of residence. We reserve the right to suspend or delete your Legendary Program access if, in Good Story Vacations LLC’s sole discretion, you are deemed to have violated the Complete Terms and if required to do so under any law, regulation or policy.
Indemnification & Limitation of Liability
The Program is provided without any warranty (either express or implied) or implied term of any kind, including but not limited to, any implied warranties or implied terms of satisfactory quality, fitness for a particular purpose, or non-infringement. We make no guarantees, warranties, or representations of any kind concerning the Program, except where a particular guarantee or warranty cannot be excluded under applicable law.
Although we will endeavor to employ commercially reasonable measures to help ensure the Program operates smoothly and as intended, you agree that we shall not be liable for any errors, inaccuracies, or other issues that may impair or limit your participation in the Program. Without limiting the generality of the previous sentence, by participating in the Program, you agree to indemnify, defend, release and hold us harmless, and each of our respective officers, directors, employees, and affiliated agents and advisors (collectively, the “Released Parties”) from and against any claim or cause of action arising out of your participation in the Program. Subject to the limitations set out in these Program Rules, you further agree that the Released Parties will not be liable for any losses arising out of or in connection with the Program.
Notwithstanding the foregoing, (i) in no event shall the Released Parties be liable for any business losses and/or losses to non-consumers including (without limitation) loss of profits or loss of revenue, and (ii) regardless of any statute or law to the contrary, any claim or cause of action arising out of, related to or connected with your use of our Program must: (i) be notified to us within thirty (30) days after your issue arises in connection with the Program and (ii) be filed within ninety (90) days year after such claim of action arose, or such claim shall be forever precluded and banned.
Dispute Resolution
You hereby agree to provide us with ample opportunity to resolve any disputes or claims relating to the Program and dealings with this Company by contacting us at: legendary@goodstoryvacations.com. If we are unable to reach a resolution within ninety (90) days of receipt of your request, you may seek relief through a single arbiter arbitration.
To seek arbitration after the ninety (90) days, please provide us with delivery of written notice of intent to arbitrate clearly stating your position including, with particularity, a statement of your position and summary of arguments in support of your position. Within twenty (20) days of the delivery of said notice, we shall respond in writing. Within thirty (30) days of delivery of the response, both Member and Company (collectively, the “Parties”) and/or their representatives shall participate in a video or telephone conference at a mutually agreeable time in an attempt to resolve the dispute. If the dispute cannot be resolved following the conference, the matter shall be resolved by a single arbitrator, that is mutually agreed to by the Parties and such judgement and aware rendered by the arbitrator shall be legally binding and entered in any court having jurisdiction thereof.
THIS ARBITRATION CLAUSE IS A WAIVER OR JURY OR BENCH TRIAL, AND SUCH ARBITRATION SHALL BE BINDING UPON THE PARTIES.
Governing Law; Miscellaneous
These Program Rules and the rights of the parties hereunder shall be governed by and construed (for both substantive and procedural purposes) in accordance with the laws of the State of Illinois exclusive of conflict or choice of law rules. Any claims shall be brought in a court of competent jurisdiction located in Illinois. YOU AGREE THAT YOU WILL ONLY BRING CLAIMS AGAINST US IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION OR REPRESENTATIVE PROCEEDING. WE SHALL NOT IN ANY CASE BE LIABLE FOR OTHER THAN COMPENSATORY DAMAGES, AND YOUR USE OF THE PROGRAM MEANS THAT YOU AGREE TO THESE CONDITIONS AND EXPRESSLY WAIVE ANY RIGHT TO PUNITIVE DAMAGES.
If any part of these Program Rules is found to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions will not in any way be affected or impaired. Our failure or delay in enforcing any provision in these Program Rules at any time does not waive our right to enforce the same or any other provisions hereof in the future. The Complete Rules constitute the entire agreement between you and us with respect to the Program and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and us with respect to the Program.
